Terms of Use
Effective September 1, 2026
By downloading, installing or using the Careping app (the “App”), you agree to be bound by these Terms of Use (the “Terms”). If you do not agree, do not use the App.
1. What Careping Does
Careping is a personal check-in and safety notification app. Users check in regularly, and the App automatically notifies designated emergency contacts if a user stops checking in for 48 hours.
Careping is NOT a substitute for emergency services. If you are in immediate danger, call 911 or your local emergency number.
2. Eligibility
- You must be at least 13 years old to use Careping.
- If you are under 18, you must have permission from a parent or guardian.
- You confirm that the information you provide is accurate and complete.
3. Your Account
- You are responsible for keeping your account credentials secure.
- You are responsible for all activity that occurs under your account.
- If you suspect unauthorized access, contact us immediately at support@care-ping.com.
- You may delete your account at any time from within the App or by contacting us.
4. User Roles
When you sign up, you choose one of two permanent roles:
- Pinger: You check in regularly. Your emergency contacts are notified if you go silent.
- Guardian: You monitor one or more Pingers and receive alerts if they go silent.
Your role is permanent for that account. To use both roles, you must create a separate account for each.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Submit false check-ins or false emergency alerts.
- Impersonate another person.
- Attempt to hack, reverse-engineer, decompile or disrupt the App or its servers.
- Use the App to harass, stalk, or monitor someone without their consent.
- Add someone as an emergency contact without their knowledge.
- Use the App in any way that violates applicable laws or regulations.
We may suspend or terminate your account at any time if you violate these rules.
6. Emergency Contacts
By adding someone as an emergency contact, you confirm that:
- You have their consent to add them.
- They understand they may receive alerts, location information and proof-of-life videos about you.
- The contact information you provide for them is accurate.
Careping is not responsible for how emergency contacts respond to alerts, or for any failure by a contact to act on an alert.
7. Location and Video Data
The App tracks your location in the background and may store video recordings you make during check-ins. By using these features, you consent to this collection as described in our Privacy Policy.
You can withdraw consent at any time by disabling location permissions in your phone settings or by deleting your account. Note that disabling location will limit the App’s core functionality.
8. No Emergency Dispatch
Careping does NOT contact emergency services (911, police, fire, or EMS) on your behalf. The App only contacts the emergency contacts you have designated.
If you need immediate emergency help, call 911 or your local emergency number. Do not rely solely on Careping in an emergency.
9. Beta and Early Access
Parts of the App may be offered as beta, early-access or preview features. These features are provided for testing and may contain bugs, errors or interruptions. We may modify or discontinue beta features at any time without notice.
10. Communications
By creating an account, you agree to receive:
- Service-related emails and push notifications (check-in reminders, alerts, security notices).
- Occasional product updates and announcements.
You can opt out of non-essential communications at any time in the App settings, but you cannot opt out of essential service messages while your account is active.
11. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that the App will be:
- Available at all times or free from interruption.
- Free of errors, bugs or security vulnerabilities.
- Accurate or reliable in delivering alerts within any specific timeframe.
- Compatible with every device or operating system.
You use the App at your own risk.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CAREPING AND ITS OWNERS, EMPLOYEES, AGENTS AND PARTNERS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, consequential, special, exemplary or punitive damages.
- Any loss of profits, revenue, data, business or goodwill.
- Any failure or delay in sending an alert to your emergency contacts.
- Any failure by an emergency contact to receive, read or act on an alert.
- Any harm that occurs during or after a missed check-in.
- Any loss of data, service interruption or technical failure.
- Any act or omission of third-party service providers.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100 USD, WHICHEVER IS LESS.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend and hold harmless Careping and its owners, employees, agents and partners from any claims, damages, losses or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the App.
- Your violation of these Terms or any law.
- Your violation of any third party’s rights.
- Content you submit through the App.
14. Intellectual Property
All content, design, code, trademarks and other intellectual property in the App is owned by Careping or its licensors. You may not copy, modify, distribute, reverse-engineer, decompile or create derivative works of any part of the App without our prior written permission.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice at least 14 days before the change takes effect. Continued use of the App after the effective date means you accept the updated Terms.
16. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the service.
You may stop using the App and delete your account at any time. Sections 11, 12, 13, 14, 20 and 21 survive termination.
17. App Store Terms
If you downloaded the App from the Apple App Store:
- These Terms are between you and Careping only, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide support or maintenance for the App.
- In the event of a product warranty failure, you may notify Apple for a refund, but Apple has no further warranty obligation.
- Apple is not responsible for any third-party claims relating to the App or your use of it.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded the App from the Google Play Store, similar terms apply with Google as the third-party beneficiary.
18. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, government actions, internet outages, cellular network failures, power failures or third-party service provider failures.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Subject to Section 20, any disputes will be resolved in the state or federal courts located in Delaware.
20. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL OR CLASS ACTION.
Step 1, Informal Resolution. Before filing any formal claim, you agree to contact us at hello@care-ping.com and try to resolve the issue informally. We will respond within 30 days. Most concerns are resolved this way.
Step 2, Binding Arbitration. If we cannot resolve a dispute informally within 30 days, you and Careping agree to resolve any claim through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware or via video conference.
Class Action Waiver. YOU AND CAREPING AGREE THAT ANY DISPUTE WILL BE BROUGHT INDIVIDUALLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION OR REPRESENTATIVE PROCEEDING.
Exceptions. Either party may bring claims in small-claims court, or seek injunctive relief in court for intellectual property infringement.
Opt-Out. You may opt out of this arbitration agreement by emailing hello@care-ping.com within 30 days of first creating your account, with the subject line “Arbitration Opt-Out.”
21. General Provisions
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Careping.
- Severability. If any part of these Terms is found unenforceable, the remaining parts continue in full effect.
- No Waiver. Our failure to enforce any right is not a waiver of that right.
- Assignment. You may not assign or transfer these Terms. We may assign them at any time without notice.
- No Agency. Nothing in these Terms creates an agency, partnership, employment or joint-venture relationship.
- No Third-Party Beneficiaries. Except as stated in Section 17, these Terms do not create any rights for third parties.
